Out of Land and Out of Pocket: An Update on Disturbance under the NSW Land Acquisition (Just Terms Compensation) Act 1991 – Nick Brunton
The historical and legal context of claims for disturbance costs following the acquisition of land by public authorities in New South Wales was analysed in detail in 2012. Disputes about the entitlement to such costs remain common and often result in protracted litigation. Yet despite the many cases, a coherent and consistent approach on many issues remains elusive. This article traverses the legislative and judicial developments with the aim of providing some clarity around the rights and obligations of acquiring authorities and those whose interests in land have been or will be acquired.
